Governing jurisdiction: Quebec, Canada

Acceptance of Terms

By downloading, accessing, or using Pulse, you agree to these Terms of Use. If you do not agree, do not use Pulse.

About Pulse

Pulse is a native iOS application for currency conversion, market tracking, and personal portfolio tracking. It supports fiat currencies, cryptocurrencies, metals, stocks, ETFs, oil benchmarks, charts, alerts, widgets, Siri Shortcuts, themes, alternative app icons, and Pulse Insights.

Eligibility and Responsible Use

You are responsible for using Pulse lawfully and for making your own decisions about any financial, tax, legal, or investment matter. Pulse does not require a Pulse account and does not execute transactions.

Informational Purposes Only

Pulse provides tools and information for personal tracking, conversion, and organization. Market information may be delayed, incomplete, inaccurate, unavailable, or different from other sources.

No Financial or Investment Advice

Pulse is not a bank, broker, exchange, trading platform, investment adviser, tax adviser, or financial adviser. Nothing in Pulse is financial, investment, trading, tax, legal, or other professional advice. Pulse does not execute trades or hold user funds.

Market Data Accuracy and Availability

Market data can vary because of provider methodology, trading venue, currency conversion, refresh interval, market hours, delayed data, outages, and third-party service availability. You should verify important information with appropriate sources before relying on it.

Portfolio Information

Portfolio values, performance charts, and Pulse Insights are based on the information available to Pulse and the holdings or settings you enter. They are estimates for informational tracking and may not reflect taxes, fees, slippage, liquidity, spreads, or account statements from other services.

Pulse Pro

Pulse may offer Pulse Pro features through a monthly auto-renewable subscription and a lifetime non-consumable in-app purchase. Available features, pricing, taxes, and local currency are displayed by Apple in the App Store or purchase screen before confirmation.

Monthly Auto-Renewable Subscription

The Pulse Pro monthly subscription automatically renews unless cancelled. Apple processes payment through your Apple Account. Renewal and cancellation are controlled through Apple subscription settings. Deleting Pulse does not automatically cancel the subscription.

Lifetime Purchase

Pulse Pro Lifetime is a one-time non-consumable in-app purchase. It unlocks the applicable Pulse Pro features for the purchased app, is associated with the Apple Account used for purchase, and can be restored where StoreKit and Apple policies permit. It does not promise inclusion of every future product, separate app, or unrelated service.

Payment Processing by Apple

Apple processes in-app purchases and subscriptions. Pulse receives transaction and entitlement information needed to determine access. The developer does not directly receive full payment card details.

Managing and Cancelling Subscriptions

You can manage or cancel subscriptions through iPhone Settings → Apple Account → Subscriptions. Apple controls subscription renewal, cancellation, billing, and regional purchase flows.

Restore Purchases

Use Restore Purchases in Pulse settings or the Pulse Pro screen while signed into the Apple Account originally used for purchase. Restore availability depends on StoreKit, Apple services, and Apple policies.

Refunds

Refund requests and billing issues are handled by Apple under Apple's applicable policies and support process. The developer cannot guarantee a refund decision.

Free Version and Advertising

The free version of Pulse may display banner advertising through Google AdMob. Advertising availability, personalization, and processing can depend on device settings, consent, region, Google configuration, and applicable law.

Third-Party Services and Data Providers

Pulse depends on Apple services, Google AdMob, and external market-data, chart, image, logo, or flag providers. Third-party services may change, be delayed, become unavailable, or process information under their own terms and policies.

Acceptable Use

You agree not to misuse Pulse, interfere with its operation, reverse engineer it except where law permits, attempt unauthorized access to related systems, or use Pulse in a way that violates applicable law or third-party rights.

Intellectual Property

Pulse, including its design, branding, text, interface, and software, is owned by Oleksandr Miller or used under applicable rights. These Terms do not transfer ownership of Pulse or third-party content to you.

Service Changes and Availability

Pulse features, supported assets, data providers, pricing, purchase options, and availability may change over time. The app may be interrupted by maintenance, operating-system changes, third-party outages, network conditions, or other factors.

Disclaimer of Warranties

To the maximum extent permitted by law, Pulse is provided on an "as is" and "as available" basis without warranties of uninterrupted operation, error-free functionality, accuracy, merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Oleksandr Miller will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses related to market decisions, data inaccuracies, service interruptions, lost profits, lost data, or use of third-party services.

Indemnification

You agree to reasonably indemnify and hold harmless Oleksandr Miller from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Pulse, violation of these Terms, violation of law, or infringement of third-party rights, to the extent permitted by applicable law.

Termination

You may stop using Pulse at any time. Access to Pulse or certain features may be limited or discontinued if required by law, Apple policies, technical constraints, or misuse of the app.

Changes to These Terms

These Terms may be updated when Pulse features, legal requirements, third-party services, or business practices change. The date at the top identifies the latest revision.

Governing Law

These Terms are governed by the laws of Quebec, Canada, and applicable Canadian federal laws, without regard to conflict-of-law principles, except where consumer protection laws require otherwise.

Apple Standard EULA

Apple's standard Licensed Application End User License Agreement may also apply where relevant and is available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms are intended to work alongside Apple's terms and not contradict them.
